No Liability for Vehicle Damage or Failure

Texas Tuning Xperts is NOT RESPONSIBLE for any damage, failure, or malfunction that may occur to your vehicle, engine, transmission, drivetrain, or any other component as a result of our tuning services. This includes, but is not limited to:

• Engine or transmission mechanical failures
• Electronic component failures or malfunctions
• Drivetrain damage including differential, axles, or driveshaft
• Fuel system issues or contamination
• Sensor failures or wiring issues
• Any consequential damages or losses

Assumption of Risk

YOU ASSUME ALL RISK associated with modifying your vehicle's engine control unit (ECU), powertrain control module (PCM), or transmission control module (TCM). Performance tuning inherently places additional stress on vehicle components, and you acknowledge that:

• Increased power and torque may exceed your vehicle's mechanical capabilities
• Components not designed for increased performance may fail
• Tuning may affect vehicle longevity and reliability
• You are responsible for ensuring your vehicle is in proper mechanical condition

Vehicle Condition Requirements

It is YOUR RESPONSIBILITY to ensure that:

• Your vehicle is in good mechanical condition before tuning
• All maintenance is up to date and components are functioning properly
• Supporting modifications are adequate for requested performance levels
• You have disclosed all modifications and issues with your vehicle
• Fuel quality meets the requirements of your tune (octane rating, E85 content, etc.)

Warranty Disclaimer

Our tuning services are provided "AS-IS" with no warranties, express or implied. We do not guarantee specific power gains, fuel economy improvements, or any particular results. While we strive for excellence in every tune, results vary based on vehicle condition, modifications, fuel quality, altitude, temperature, and other factors beyond our control.

Off-Road Use Only

All tuning services are intended for OFF-ROAD AND COMPETITION USE ONLY. Our services may alter emissions systems or parameters regulated by federal and state law. It is illegal to use modified vehicles on public roads in many jurisdictions. You are solely responsible for compliance with all applicable laws and regulations in your area.

Limitation of Liability

In no event shall Texas Tuning Xperts, its owners, employees, or affiliates be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of our services, including but not limited to vehicle damage, loss of use, towing costs, repair costs, personal injury, or property damage. Our maximum liability is limited to the amount you paid for our tuning service.

Client Responsibilities and Obligations

As a client, you agree to the following responsibilities:

• Provide accurate and complete information about your vehicle, modifications, and mechanical condition
• Ensure your vehicle has been properly maintained and is in good working order before tuning
• Use appropriate fuel quality and octane ratings as specified for your tune
• Follow all installation and operation instructions provided by Texas Tuning Xperts
• Monitor your vehicle's performance and report any unusual behavior immediately
• Maintain adequate insurance coverage for your modified vehicle

Known Risks and Hazards

Performance tuning involves inherent risks that you explicitly acknowledge and accept, including but not limited to:

• Engine Damage: Increased cylinder pressures, detonation, pre-ignition, and mechanical stress can lead to piston, rod, or crankshaft failure
• Transmission Failure: Increased torque can exceed transmission capacity, leading to clutch, gear, or torque converter failure
• Drivetrain Damage: Axles, differentials, u-joints, and CV joints may fail under increased power loads
• Reduced Reliability: Modified vehicles may experience increased maintenance needs and reduced component lifespan
• Safety Risks: Increased performance can make vehicles more difficult to control, especially for inexperienced drivers

No Warranty on Vehicle Components

Texas Tuning Xperts provides NO WARRANTY whatsoever on any vehicle components, including but not limited to engines, transmissions, drivetrain parts, electronic modules, sensors, or any other parts. Any existing manufacturer or aftermarket warranties may be voided by performance modifications. We are not responsible for warranty denials, even if the modification can be proven unrelated to the failure. We strongly recommend consulting with your vehicle manufacturer or warranty provider before proceeding with any modifications.

Indemnification

You agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS Texas Tuning Xperts, its owners, employees, contractors, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from or related to: (a) your use of our tuning services; (b) any damage to your vehicle or property; (c) any personal injury or death; (d) violation of any laws or regulations; (e) any third-party claims arising from your use of the tuned vehicle. This indemnification obligation survives the termination of any service agreement.

Dispute Resolution and Governing Law

This disclaimer and any disputes arising from or relating to our services shall be governed by the laws of the State of Texas, without regard to conflict of law principles. Any legal action or proceeding related to your use of our services must be brought exclusively in the state or federal courts located in Texas, and you hereby consent to personal jurisdiction in such courts.

Arbitration Agreement: You agree that any dispute, claim, or controversy arising out of or relating to these terms or our services shall be settled by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The arbitration shall be conducted by a single arbitrator in accordance with the rules of the American Arbitration Association. You waive any right to a jury trial or to participate in a class action.

Right to Refuse Service

Texas Tuning Xperts reserves the right to refuse service to any customer at any time for any reason, including but not limited to: vehicles in poor mechanical condition, unrealistic performance expectations, incomplete information provided, suspected illegal use, or any situation where we believe the service may pose unreasonable risk. We also reserve the right to cancel or refund any service request at our sole discretion.

Changes to This Disclaimer

Texas Tuning Xperts reserves the right to modify, update, or change this liability disclaimer at any time without prior notice. Any changes will be effective immediately upon posting to our website. It is your responsibility to review this disclaimer periodically. Your continued use of our services after any modifications constitutes acceptance of the updated terms. The most current version of this disclaimer will always be available at txtuning.com/disclaimer.

Severability

If any provision of this disclaimer is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render this disclaimer unenforceable or invalid as a whole. Such provisions shall be deleted without affecting the remaining provisions herein. The remaining provisions of this disclaimer shall continue in full force and effect.
